Legal Question in Civil Rights Law in Louisiana
Is it legal?
My boyfriend signed over his parental rights to the child's mother years ago. recently him and his brother went to the mom's house where the child lives because he missed his son. and she let him introduce himself to his son. next visit, she told him to leave. he most recently got arrested: there was a warrant for his arrest for not showing up in court, which he did not know about it. he never received information/a summons to appear at court. apparently the crime was RS 14:63 Criminal Trespass that was issued by the child's mother the day of the next visit. is this legal?

No it's not legal. What parish did this happen in? Want to talk about it, give me a call. My phone number is listed in my attorney profile on LawGuru. Looks like your bodyfried needs legal counsel, legal advice. He has more rights than he apparently knows about. Would be interesting to see what that document that he signed whereby you say he "turned over his legal rights" actually says. My initial reaction is to say that that unless he surrendered the child for adoption, such an agreement can be broken at any time. There is more to it all than this, but his is something to think about. Best of luck to you and to your boyfriend!
