Legal Question in Civil Rights Law in Louisiana

Im in louisiana, i rented a house for 7 months, the landlord has not paid the mortgage and now the home was foreclosed. on yesterday the sheriff served a notice of seizure as of march 16, 2010. it will go up for sheriff sale on may 5.2010. i refuse to pay anymore rent and i am currently looking for a new home for me and my 3 kids.

what type of action can i take against him?

can i sue him?

please let me know

A landlord has a duty to provide possession to the property. If the home is being foreclosed, he obviously is violating his lease. You can sue for the lease violation, but if his home is being foreclosed, you may be throwing good money after bad. He may be Judgment proof or about to declare bankruptcy if he is in such bad shape financially.
