Legal Question in Civil Rights Law in Louisiana

I was recently pulled over in my work truck on a way to a job. I was pulled over for speeding. When the officer ran my name he came back to the truck and proceeded to place me under arrest for what he called forgery. I tried to explain to the officer I had no idea what he was talking about and he had the wrong guy. I explained that I am a III and my father and grandfather share the same names. He insisted it was me and brought me in. I sat in jail for 8 hours before I was even told why I was arrested. I was charged with a fraudulent check under $100. When I finally got a close family member to post bail for me I started to investigate. Come to find out it was a check in my fathers name. I am extremely dissapointed in the negligence that was practiced in my arrest. All they had to do was check my birthdate or social. I lost work time, I was humiliated in public (this is my first time being in jail), and from now on I cannot tell any future employers that I have never been arrested. Because of the way all of this was handled by my parishes incompetent law enforcement I would like to file a lawsuit. Do I have a case? Do you have any good advice for me? Thanks in advance.

Donnie

It is unlikely you would be successful in a damage suit.
