Legal Question in Civil Rights Law in Louisiana
resisting arrest
I was a passenger on a DWI stop. During the DWI stop, the driver was having problems with the test, so I got out of the car. The police officer told me to get back in the car and I did; however, the driver ran, so I ran after them. The officer arrested me for resisting arrest. Is this legal.

It might be, but get an attorney and he should be able to help you.....if what you said is true....I have to say, if you go before the Judge he will ask...."why did you get out of the car and 'run after your friend and the policeman?'" But even if that is confusing, you were not under arrest so there was nothing to resist.
