Legal Question in Civil Rights Law in Louisiana

I have two sons that were burned with a lighter at school Friday January 30, 2010 one of them was held in the boys restroom and the other one on the bus ride home from school. Both boys will have scars for life from this one child is 13 the other is 10 who should be held responsible for this kind of treatment while at school?

Certainly the parents of the children who burned them. Possibly the school for negligent supervision of the children.
