power of attorney

I have been legally married in the

state of Louisiana for 3 years. My

husband works offshore and I have

needed to sign his name on taxes;

and other misc documents in order to

handle business at hand.

Does being legally married

automatically give me the right to do

this?

Re: power of attorney

No. He should consider giving you a power of attorney to act in his name and sign his name in his absence. I would make several originals. Just about any attorney or notary can draft and notarize the document for you. I would expect to pay anywhere from $100-$300 depending on the complexity of the power of attorney, the amount of time expended by the attorney, etc.

You can also find several forms online for powers of attorney, but they are not nearly as complete and do not take into account Louisiana's civilian rules, which are quite different than most common law states which most forms are drafted for. Even if you go that route (which I really wouldn't recommend), you still have to pay to get the document notarized anyway and you don't get the added benefit of the attorney's advice and instruction on the use of the document.
