does a roofing contractor have to refund money if contract states no warranty and no guarranty

The contract controls as long as there was an understanding of the parties, an offer and an acceptance. However, when a service is performed there is always a warranty of use. This means that the roof work must be sufficient so that the roof is in a condition which shelters. The roof is able to perform as a roof should.
