Legal Question in Consumer Law in Louisiana

Contractor trouble

I paid a contractor 75 percent of our written agreement, and most of the work is still left to be completed. The contractor states he's in trouble and would like me to pay vendors directly in order to complete work. What can I do to protect myself and get my home completed.

Re: Contractor trouble

Don't do it if you have already paid the contractor to do it. I'd have to go over your contracts and facts to know more.

Re: Contractor trouble

One thing you should do is check whether he is bonded and/or insured. Also, you can check with the State Contractor Licensing Board to see if there is something you can do to protect yourself. Yet another thing is if he spent even $1 of your money for anything other than YOUR house, there is a criminal statute that applies and he could face criminal charges.(RS 14:202) Lastly, you should contact each subcontractor, and get copies of their unpaid bills, and what they think it will take to finish the house. If you have enough money left over, then you can finish the house if you feel you can keep an eye on the progress. Otherwise, a lawyer can help, if help can be had. You may be out of money if there is no bond and he spent your money for things other than your house.
