Legal Question in Consumer Law in Louisiana

eBay issues ...

I purchased something from an eBay seller in New Jersey and I live in New Orleans. I have read another eBay horror story like mine, however I have gone through Paypal to file a claim, said claim was escalated and eBay determined that nothing could be done because they only guarantee shipment of the item, not condition. But this item isn't functioning properly and after speaking to the seller, I'm pretty sure he knew the condition. Not to mention the seller stated in the auction's description that the item stated 'nearly new'. I paid $200 for the phone, but it just seems unfair that this can happen and I have no recourse. Would a TV court show like Judge Mathis be appropriate?

Those shows require that both sides agree, and this person isn't likely to go on TV to have a TV judge point out that they are scam artists, but just maybe they are that stupid...assuming the show is interested. Otherwise you can file a small claims action where the defendant is located in NJ, but that probably isn't worth it. So give them some very bad feedback on eBay and complain to the BBB in NJ.
