Purchase Agreement and Hurricane Katrina
I signed a residental purchase agreement on August 23, 2005. I didn't have a natural disiater clause. Fortunatley, my parish only had minor damages from Hurricane Katrina. However; my builder has informed me it will now cost over $10,000 more to build my home and doesn't know when he will be able to build it. Due to this natural disaster, I would like to void my purchase agreement because I now have no place to live and there are no homes to purchase due to the flood of evacuees. I want to keep my current home. Can I void this agreement, due to the natural disaster of Katrina? Please respond ASAP. Thank You!

It sounds like your builder is attempting to modify the agreement that was entered into prior to Hurricane Katrina. If these modifications are unacceptable; and he is unwilling to perform the contract under the original terms, you can typically get out of the contract. However, before you take such a position, I would highly recommend having an attorney review the actual contract.
