Legal Question in Consumer Law in Louisiana
What are my rights if I sell a television to a neighbor and they come back two days later and say they want their money back because they were dissatisfied with the television. Also, they came and inspected and watched the television before they decided to buy it.
1 Answer from Attorneys
If they were only "dissatisfied", they have no case. If the television had a latent defect (e.g., is broken) which you did not tell them about before the sale, they may have some rights to rescind the sale or reduce the sales price under the law of redhibition. Redhibition law states that any defect which arises in a movable (something other than real estate) within 3 days of the sale is presumed to be a defect that existed prior to the sale. So, the seller could be liable for that defect and could be forced to refund the money.
