Credit Card Debt/Petition Served

Today I rec'd a Petition from Whitney Bk re a VISA unpaid balance. ($5300) I paid on this account regularly prior to Hurricane Katrina. But since returning home, was left unemployed and with little assets. However, my wood frame home is paid for and my son (who is a new MD) sends $$$ for my utilities while pursuing SS. I do also have a 1998 vehicle paid for

and all $$$ to my name is in my checking. What should I do to protect myself? Petition says they made amicable demand but the only thing I rec'd is a statement since the hurricane and I wrote on it as instructed at the time. Anything you can suggest is appreciated. Should I take my money out of my account? Should I put my house in another name? I'm really worried and I can't afford anything. It's all I can do to survive! DS

You should consult with an attorney as soon as possible regarding your rights. It is very important to properly respond to such lawsuits or they can get a judgment against you.

If they get a judgment they can start seizing non-exmpt assets and garnish your wages.

Obtaining an attorney to advise you on what you should do is not always as expensive as you might think.
