Legal Question in Credit and Debt Law in Louisiana
I had a debt collector call me and threating me by saiding he was going to sue me, garnish my wages, or go in my checking account and take out funds. He ask for Charles Ferrier Jr. but that was not me I have no children. He said I was lying son of bitch. I said there is no Jr. he again said I was a lying son of bitch. So I ended the call. The next day I call back and he was much calmer than. He told me he wanted my checking account infomation or he was going to sue me. So I found out that indeed I owed money on this account and gave him my checking account info. He said I could not mail in a check because he was charging me a fee of $13.95 per month to take money out of my checking account. I told I rather pay by check he said that I could only let them take money out of my checking by debiting my account monthly. He never send me a written validation notice. I found out that he works in the collection dept. at a law firm. His name is Reggie. Is this legal?
