Legal Question in Credit and Debt Law in Louisiana

Went to the doctor in 2006, right after Hurricane Katrina. Now after almost 5 years they are coming at us to pay the bill which is almost 4,000. They want us to pay half now and 315 a month for 6 months. is this right? we never received a bill stating we owed anything until it went to the collection agency.

A creditor can file suit against a debtor for up to 3 years from the date of last payment. Three years from September 2006 is September 2009 and it is now September 2010. If you have made no payments since you received treatment, the debt is prescribed.

A debt collection agency purchases the debts from the original creditor and then attempt to collect the debt. Some take a percentage of the amount collected and some may be retained at a certain fee. Their aggressiveness in collection of debts may reflect in the methods they use to collect. If you plan to repay the debt, save your money until you have the full amount owed, then go to the doctor at pay them directly.
