Legal Question in Credit and Debt Law in Louisiana

My husband died without a will in Louisiana. I would like to sell the house since I can no longer afford the note, One son refuses to agree to the sale because we are astranged. What can I do as the house is too large and costly on my salary. I have a little insurance money and I am thinking about buying a small home and then letting the other house foreclose. I am 60 years old and a teacher.

In Louisiana, you cannot be forced to own property with someone-an undivided interest. You need to file the succession for your husband and have the court order the sale. Your son will be compensated for his portion, if there is any profit.

I agree with Ms. Lucas. Ask the court to sell it. Or if you know someone who wants to buy it, ask the court to approve that sale.
