Legal Question in Credit and Debt Law in Louisiana
I owe a hospital bil of $380.00. I recieved a call from someone who said they were an attorney and told me that we could do a payment plan of $25.00 a month. This was after I explained that I was a victim of an armed robbery. I was on W/C and would send as much as I could per month. She got real nasty so I said fine I will send in $5.00 a month and she would have to except that or else the bill would be paid. She then stated that she would put a lein against my property. I told her I had no property and she said "you have a car don't you?' I said yes and she said she would see me in court. My question is if all I can afford is $5.00 a month do they have to accept that?

You can pay the amount you can afford. They may turn you over to the credit bureau as slow pay, which they have a right to do. They would have to sue you, present evidence, allowing you to present your side, have the court rule in their favor and then receive a judgment against you. They would then have to file more papers and receive another judgment before they could seize anything you own.
