Legal Question in Credit and Debt Law in Louisiana

SA Citizen in Louisiana owing me money

Person was appointed as a sub-contractor to complete a specific job. After completion, he was paid by my customer - but did not pay my commission. This occurred with many contracts/jobs.

He was given ample time to pay his debt. Next moment we learned that he left the country and fled to Louisiana, USA. We have tried several institutions to help us trace him down but with no luck. We sent letters to the "US Immigrations Services" as well as the "US Immigration and Naturalisation Service" but have had no reply. We also believe that he is illegally working in your country.

We are desparate and seeking help in ways to get this man to justice. We also learned that he is in the process of changing his identity here in SA. Could you please forward us by e-mail some recommendations and suggestions.

Re: SA Citizen in Louisiana owing me money

As you have quickly discovered, your biggest problem is trying to locate this "fast-moving target". Until your debtor can be located, you are probably going to have an almost impossible time trying to recover anything. If he is working in U.S. in Louisiana and you can find out exactly where, he can be sued and you can seek to obtain a judgment against him based on your contract and the unpaid commissions he allegedly owes to you. Assuming you can get that far, you can then seek to garnish his wages/income from his employer. However, if and when he quits his job and moves again, the "hunt" begins anew. You indicate that he is trying to "change his identity in SA". How do you know this? Maybe the SA authorities can help you find out his "new identity" and/or his current exact whereabouts (address in U.S.). Good luck...
