Dear LawGuru Friend,

One essential element of most any crime is "criminal intent". Some crimes required only a "general intent" and some, such as murder and such require a "specific intent". What the defendant knew or did not know is an a factor or element certainly to be figured into the mind of the jury (or trier of fact) in deciding whether or not the defendant did or did not "intend" to commit the crime. That is about the best answer I can give you based on the assumed facts inherent in your general question. Of course, there is more to it all than this, given the whole facts of the case, but this is something to think about. Good luck!
