What is punishment for this crime(aggravated assault)It is not considered a felony??

It could be a felony. If a firearm used, then it is if the firearm is discharged. If on particular people like a peace officer, utility employee and the like. Other dangerous weapons use results in a misdemeanor. Check Revised Statutes 14:36 and following.
