Legal Question in Criminal Law in Louisiana
what should your attorney do?
if you go to court and the judge tells the district attorney that he has no case and there is not enough evidence to convict person of anything, but enough to hold him in a high profile case and trial date is pushed backed, what should to attorney do.

Re: what should your attorney do?
Ask for a bench trial with that judge presiding, and a speedy trial. Of course, after a trial in a high profile case, the Judge may convict. If I were your lawyer, and you were in jail, I would get your bond reduced so you can get out. Once you are out of jail, I would wait and wait and wait. Then meet with the DA and try to figure out how charges can be dropped without anyone being embarassed. Others I am sure would disagree with me, but my goal would be to obtain a dismissal or a not guilty. Going to trial is dangerous because conviction is a possibility. Waiting never ended in a conviction. You still would have the right to a trial.
