Legal Question in Criminal Law in Louisiana
ok My boyfriend is currently in jail for supposedly sending lude text messages to a minor. He was forced into a confession by the detective questioning him by the detective threatening to put it all off on me. The detective has sworn in court that he has never seen the text messages and att the phone provider cannot find in their records where they were ever sent to the phone number in question. So therefore there is no proof that the crime was ever even committed. They are trying to use this confession to give him six years. How is it possible that they cannot even prove the crime ever happened but they are pushing this so far?

It will depend on what type of additional evidence they do have as to whether they can prove the crime beyond a reasonable doubt.
