Legal Question in Criminal Law in Louisiana

ceased money

My boyfriend had his car stolen a week ago from his daughters mother then the following week she assaulted him in a grocery store and called the police. The police went to his house and searched him, he had 3 maijuana smokes on him and the money his mother just gave to him to help buy a new car of $8000. The police took the money and he spent a night in jail. They wont release the money because they said it's drug money which it absolutely isnt. He was told to go to court in August to try to get the money back, but he has to write a proposal. HOW DO WE WRITE THE PROPOSAL LETTER?

P.S. No charges were filed against him, just the money ceased.

I strongly reccomend hiring a criminal defense lawyer to represent him at the hearing. Additionally his mother should be there to testify about the source of the money, preferrably with records showing that she legitimately had the money (eg. records showing a bank withdrawal).

I also think he needs a restraining order keeping the child's mother away.
