Legal Question in Criminal Law in Louisiana
charges had expired
i was arrested in aug 06, never arraigned and never went to court. I was told in nov of 06 I had been taken off the docket. It was a felony and there is a 2 year statute of limitations. They ran out on 09/08. But the case was dismissed on dec.5 2007. Does the da have the right to issue a warrant for that same case based on the dismissal or the expiration date and why would he if he declined prosecution the first time.

I assume this is the same question I answered yesterday. If dismissed under 691 of the criminal code, then look under 693 to see what effect that dismissal has. You need to speak to the DA to find out why he would re-charge you.
