Legal Question in Criminal Law in Louisiana
If someone contests two simple battery charges in Louisiana what happens? My ex husband's fiance pulled my childrens pants down, wrote on their bottoms and then took pictures to send to my ex while he was work. Both of these people see nothing wrong with this act and think it was funny. The police department is charging the fiance with simple battery. If she chooses to fight it, what will likely be the outcome in court?

Simple battery is the intentional infliction of force or violence upon the person of another, with the intent to harm. I'm not sure what you've described would be battery. If she pleads not guilty, there will be a trial and the prosecution will have to prove the act fits the statute and that she was guilty beyond reasonable doubt. What would be more effective, would be to bring this to attention of your custody judge.
