Legal Question in Criminal Law in Louisiana
Second Degree Assault
My son is serving a five (5) year term for''Second Degree Assault''. He was orginally told that he would have to serve half of this term before he would be eligible for parole. Recently, he was told that he would have to serve eighty-five (85) percent of his time before he would be eligible. I would like to know what the Law is on this matter. Any help in this matter is greatly appreciated.

The difference is probably related to his criminal record. In Louisiana a first-time felony offender must serve one-third (1/3) of the sentence imposed before parole can be granted. A second offender serves one-half, etc. If there is an extra felony on your son's record, then the sentence goes up.
