Second Degree Battery Charge

son was in a fight that was provoked by the guy that he hit..this guy had already been in two altercations with other people at the same place..same time..he came towards son and told him he was going to whip his butt..son does not know this man..never saw him before the fight..guy just got out of prison about a month ago..had been causing trouble in the parking lot..officers were time during the beginning to the end of the situation..should they have stopped this before it came down to a fight..can't son defend himself?

Second degree battery is fairly serious, so I am guessing your son either hit him with an object, or continued to hit him after he man was no longer a threat. No matter the exact facts, your son should get an attorney right away.

In La., any person charged with a crime has the right to defend himself in court. Of course, we would always recommend he be represented by an attorney. If he can't afford an attorney, the court should appoint the public defender to represent him at little or no cost.
