First degree robbery
My son was charged with first degree robbery. He went into a Shell sation with bb gun placed the gun on counter and asked for money in register. He changed his mind and left without touching the money and left bb gun behind on the counter. Wouldn't this be considered attempted first degree robbery? He had previous convictions (2) breaking & entering and served time. Each time he has committed a crime of this nature he was on Xanbars... he needs drug rehab more than anything else. This would be his third offense. How much time can he get first degree robbery versus attempted first degree robbery?

First degree Robbery carries a minimum of 3 years up to 40 years at hard labor without the benefit of probation, parole, or suspension of imposition or execution of sentence. R.S. 14:64.1.
Attemped first degree Robbery carries from 3 years to 20 years at hard labor without the benefit of any of the above. I would suggest you get him into an inpatient rehabilitation facility. But it is probably too late now.
