Legal Question in Criminal Law in Louisiana

Expungement of Attempted Simple Burglary of Inhabited Dwelling

Please Help

I was convicted of this crime in 1993 and was sentenced to 4 years probation. I now have a Verification of First Offender Pardon, however, I would like to have this expunged from my record so I can hunt with family and friends. In R.S. 14:95.1. I do no carry the right to receive, possess or transport a firearm. I would like to have this right. I did not commit this crime with a weapon.

It is very embarrassing and it would be greatly appreciated to receive some information back.

Re: Expungement of Attempted Simple Burglary of Inhabited Dwelling

Although La. R.S. 44:9 does not allow for expungements of convictions, we have had a number of felony convictions expunged for our clients. In fact one was offered a job with the court as a baliff, but had an old DWI conviction which would have prevented him from taking that job. The DA's office helped us get that one expunged. There's no guarantee that a court will expunge your conviction, but if you don't try, it will never be expunged.

I must be mistaken because I thought a first offender pardon restored the right to bear arms. But if not, I do not think you can get your records expunged unless you were sentenced under a provision in the law that allows that. Maybe someone else can correct me if I am wrong.
