Felony Charge?
I was caught shoplifting. When the police came they searched my vehicle which contained approx.$50.00 in merchandise and I was still in the est. with approx. $100.00 in merchandise. I was volunteering in the establishment which is a closed in flea mkt. The $100.00 in goods were in my booth. Where I was anything over 100.00 is a felony. Can I be charged with a felony since I did not leave the premisis with over 100.00 in merchandise.

Yes....intent to permanently deprive another of their property is all that is necessary. Leaving the premises is a rebuttable presumption that you intended to permanently deprive.
