How do I file for expungement of a misdemeanor in West Baton Rouge Parish, Louisiana? First time offense.

Unless you entered a guilty plea under LRS Article 894, you may have a difficult time getting an expungement. However, to file, go to the Clerk of Court's office in the Parish where you were charged and convicted or plead guilty. Ask for an expungement form as well as pertinent information such as the date of conviction/plea; the Docket/Case Number; Offense; and anything else necessary.

Complete the form and submit it along with the filing fee. Depending on the jurisdiction, fees can be $100 or more.

The motion will be forwarded to the District Attorney's office and then on to the Court. If the DA has no objections, the motion will likely be granted. If not, you may have to argue and explain why the Motion for Expungement should be granted.
