Legal Question in Criminal Law in Louisiana
Filing a Motion of Discovery
I am going to file a Motion of Discovery in a case against me. How will it help me when I go to court.
I was also arrested on a warrant and was not read my rights.
Is there a law that says my Miranda Rights should have been read?

Re: Filing a Motion of Discovery
As a result of your discovery motion, you will get a copy of the initial offense report; your rap sheet, if any; and copies of any test results. Miranda only applies if the state intends to use incriminating statements you made to the police, in which case you can move to have them suppressed.
