They cannot hold the check. It sounds like you do not know all the facts. Threw a lighter on the ground and someone took it........not enough information. But no matter what, they cannot hold the check unless they have a legitimate offset and then they can only withhold the amount of the offset. If your friend is arrested wrongfully, then they may be able to make big bucks. You need your friend to ask the question.
