Hit & Run in Shopping Center Parking Lot
If you are an employee in a store and your car is parked in the parking lot
of that store and your automobile is hit and run while you are at work is there
any liability on the part of the parking lot or company that you work for?
A shoplifter was spotted in a shoe store that my daughter is employed by. When
the shoplifter realized they were caught and was being approached by security of
the store - the shoplifter fled the scene. Security of the store went out of store
running after the shoplifter. The shoplifter jumped into their vehicle and struck
my car that was parked next to the shoplifter's automobile. There were witnesses
and they were able to get a driver's license. However I was informed that the person
had a Mississippi license and may not have insurance. I only have liability insurance.
If the shoplifter has nothing am I stuck with the bill or is there any responsibility on the
part of the store or parking lot of the shopping center?
The police officer told me not to get an attorney because it was a waste of money. I
need some guidance. I will hire an attorney if I can sue and the store or parking lot have
some liability. Please help!

Contact a lawyer. There is a possibility that you have a case but there are more facts needed.

From the facts as given, it is hard for "me" to see what the parking lot or store or security did wrong. But, see an attorney, there may be facts that would prove me incorrect. Of course the individual shoplifter would be responsible, even with no insurance. I ALWAYS counsel my clients to have uninsured/underinsured coverage.
