Legal Question in Criminal Law in Louisiana

My husband and I are both charged with aggravated battery. We were arguing and out of anger I hit him with a glass cup :( we both freaked out and he called the cops bc he needed stitches. They arrested us and were very nice to us, just doing their job. I told them he choked me...he didn't, I hit him so anyone hit with a glass would react by grabbing the person and moving them. I don't blame him! Were 24 and love each other so much!! I started therapy to deal with past issues that have brought me to this crazy angry situation. We just want this to go away. Do we need a lawyer? What should we do? Were on each others side.

It will be very difficult to prove a case against either of you if you choose not to testify against the other. Probably the best thing to do is to make an appointment with the District Attorney, go in together and let him/her know what you are doing to correct the problems leading to the domestic violence. If the District Attorney is still going to pursue, you should have a lawyer. It is the duty of law enforcement to make whatever charges necessary to prevent further domestic violence from occurring at the time of the incident.
