Legal Question in Criminal Law in Louisiana
My husband was a passenger. They got pulled over and the driver had marijana in the car. The arresting officer was told by the driver that the drugs his and not my husband. Both of there bond is 120,000. The driver has bonded out. My husband was told if the driver does an affidavit they would let my husband go. I want to know if that is true and does my have a chance to bet this case if he doesnt get the affidavit

It doesn't really matter who the drug belonged to as long as they both knew or should have known it was present. Prosecutors will often allow one defendant to take the charge and dismiss charges on the other person.
