Legal Question in Criminal Law in Louisiana

In jail for 13 months with no trial

I have two cousins from virginia beach. There's no question of their guilt, but they're being held in Louisiana and have been for the past 13 months without even having had a trial. Is this what we consider due process? What can be done about it?

There can be any number of reasons as to why this is happening, but before any intelligent answer can be given, more facts would have to be known. For instance, are they being detained on Federal or State charges? Did the crime occur in Louisiana or somewhere else and they are fighting extradition? Or even, perhaps, they have retained or been appointed an attorney who is in the process of negotiating on their behalf. These, as well as many other questons need to be asked before you can get some answers. Also, where in Louisiana are they being held and under what charges? It would indeed be unusual for them to just be sitting there with no action being taken. I would think a good place to start getting answers would be to find out where they are and if they have representation. Good Luck.
