Legal Question in Criminal Law in Louisiana

We have had some things missing around the house, minor things. Things like caps, tools, etc. We never had this problem before our new neighbor moved in about 8 months ago. They have a 5 year old boy. We live on a bayou, and a few months ago someone saw the 5 year old throw another neighbor�s hardware in the bayou. We are trying not to think the worse, but, the 5 year old came over yesterday and my husband told the 5 year old he had some things missing and told him what was missing. Repeatedly the 5 year old told my husband that his things could be in the bayou. These things were under our carport and in the shed not inside our home.
Can we take any action on this matter? Thanks

Five year olds (very young kids) do strange things. Of course, the child's parents are civilally responsible for what he does. I suggest you handle it gently and discuss this matter with them. I have as fine a boy as ever lived, a graduate of Annapolis in Mechanical Engieering, and a very successful Naval officer; and the only thing that I know of that he ever did wrong was when he was about that age, 5, the neighbor across the street came over one day and said, "Mr. Parkerson, I hate to broach this matter, but I've been setting out seedings in my yard, and someone has been pulling them up. I got to watching one day, and it's your son Blaine." To this day we cannot figure out what made this five-year-old do that, and he's never been able to explain it either. It's just part of growing up, as I see it. In my opinion, this is nothing that one should get the cops involved in, nor even juvenile authorities. Just watch your personal belingings a little closer, and if you find out this kid is throwing things in the bayou, discuss it with his parents, and hope they don't beat the kid. That's my advice as a person. Yes, legally his parents are responsible, but I belive that a five-year-old is incapable of committing a crime. Best of luck with this interesting problem.
