Legal Question in Criminal Law in Louisiana

kidnapping

I was arrested based on my husband's ex-wife's false statement to a justice of the peace alleging that he and I refused to bring my three step-daughters back to her after Hurricane Katrina. She made these statements when she knew we were on our way back after 3 three weeks of evacuation. She knew that when we left that morning from Houston and that is when she went to the local J.P. and made her statements. We had actually picked the children up from her 4 days after the hurricane, we then went to Houston, TX. She knew where the children were, we actually offered for her to come there as well until the area we lived ''came back''. Schools were closed at the time and when their schools were announced to be opening we returned the children to Louisiana. I was also told that the governor of LA had closed all Justice of the Peace offices. What are my options? The DA refused to pursue the charge of course however I had to hire an attorney to even talk to the DA. Is there a criminal charge that I could pursue against her or is it too late to file a civil suit to regain the money I had to pay for the attorney as well as the emotional distress that I still suffer from?

Re: kidnapping

You have a year to file a civil lawsuit. Also, you may want to check with the State of Louisiana Attorney General's office for help in figuring out how to file a complaint against the JP.
