first offenders program
what are the chances of a mother who received first offenders for marijuana in 1980 to receive first offenders again in 2007. She is charged with possesion of crack,drug paraphanelia,and illegal use in the presence of her child? If this is not possible what is an approximate sentence.

If the marijuana conviction was for simple possession it is a misdemeanor and she would be a true "first offender" as to felonies. If the old conviction was a felony then a first offender pardon would not remove it from her record and she could not be a "first offender" twice.
