Legal Question in Criminal Law in Louisiana

Oil, Gas, Mineral Lease

Land man says he has a lease which I signed. I have not signed a lease. Someone has signed the document with my name. I can only suspect my tenant may have received the document and signed it in hopes that checks would be sent to the property address in Louisiana and not to me in Texas.

What should I do and who should I contact?

Contact your local law enforcement office and make a complaint of possible forgery. The police will take it from there. You may also want to consult with a civil attorney about the possible ramifications of the signed lease floating about. Good luck.

First get a copy of the lease, so you can have the signature. Then tell the leasing company of the forgery. Make sure they understand that sending any money to the wrong person does not relieve them of paying you..."if you decide to lease the land to them." Remember, if the lease is a forgery, then they owe you nothing, and they cannot enter your land. So, if you want money, they must have wrongfully taken something from your land or somehow damaged your land. Otherwise, the complaint they have is with the forger. Next, contact the sheriff's office where the land is located, or where the forgery probably took place. Lastly, terminate the tenant if you really believe they forged the document.
