Legal Question in Criminal Law in Louisiana

I was ordered to pay restitution for a crime I did not commit. I receive $558 per month. The 1st circuit Court upheld the conviction of the District Court but said the court should have a hearing with me to determine restitution and it should be based on my earnings and assets. There was no hearing, and the probation officer told me the Judge wanted me to pay $383, and he does what the Judge tells him to do. I had no prior criminal record, and the matter which I was convicted for was not even a criminal matter. I stopped payment on an overpaid check to a unlicensed, unbonded contractor from another state, in the aftermath of Hurricane Katrina, when he refused to return the check for another one. What can I do about this outrageous restitution. This court has it in for me. This restitution is excessive and unreasonable, and harsh.

The alternative to restitution is normally jail or community service. The judge determines hardship. You can contact the judicial board of ethics if you feel there was some wrongdoing by the judge.
