Legal Question in Criminal Law in Louisiana
Plea Bargain
My brother is about to face a charge for burglary. When I first talked to the DA, he told me that if he plead guilty, they would offer him 3-5 years. Now he is saying that he will probably get 20 years. Isn't that a violation of a plea bargain, like when the judge asks you if you were promised any leniency other than that which the court has accepted? Couldn't you say yes and have something done about it?

The DA can do what he wants. Even if the DA made a "deal", the court does not have to follow it.
