Legal Question in Criminal Law in Louisiana
PROHIBIT DRUG PARAPHERNALIA/THEFT OF GOODS UNDER $300
I'm in New Orleans, LA. I'm basically wondering if these are both misdemeanors and what could happen whenever he goes to court and pleads guilty? Also, how long could his sentence be? He hasn't had any prior drug or theft convictions either. Please help me out! Thank you!

First offense Possession of Paraphernalia & First offense Theft under $300.00 are both misdemeanors. The maximum incarceration is 6 months in Parish Jail on each. The maximum fine is $500.00 on each. I would be surprised if a judge put a first offender in jail for these offenses. The result would probably be a fine and/or some probation.
One thing to remember, both of these crimes are enhanceable, meaning that a second or third offense would come with a more severe penalty.
