Both charges are misdemeanors. More than likely, if you plea, the penalty will be a fine and cost and probation. However, possession is an enhanceable crime which means each time you are convicted, the penalty is increased. There is a program called Pretrial Diversion. It is for first time offenders and is set up as a DA/prosecutor probation period along with fees and fines. When you complete the program successfully, the charge is dead-filed and prosecution is not completed. You receive no conviction. You should make an appointment with the prosecutor or DA to request admission into this program. If you qualify financially, you can have a public defender appointed. Then your attorney can make the PTD request. It is always advisable to be represented at court.
Get your own lawyer, retained or court appointed, before you approach the DA. Otherwise, Ms Lucas analysis is correct.
