Legal Question in Criminal Law in Louisiana

record expungement

I want to find out how to get my record expunged, if it is even possible.

Is it possible to get a 22 year old, dismissed charge of attempted murder expunged if I have no other records before or after this incident occurred?

Re: record expungement

Dear LawGuru Friend,

Expungements are a matter of statutory law. Almost every state, if not all, has its own expungement statute. You should get a copy of your state's expungement statute, read it and study it and act accordingly. Most expungement statues for differents states are somewhat similar. New Orleans Legal Assistance Corporation (NOLAC) used to have a web-site with a good Expungement section on it. Of course, this applied to LA law. However, I looked for this today and could not find it. Seems they have changed their web-site. You might call them and find out how to access the Expungement Section that used to be on their web-site and read what they have to say. You may be good enough with a computer to go to the Legal Information Institute (LII) that is put out by Cornell Law School and find the expungement statute for your state. Also, call the D.A.'s office in your state and inquire if your record can be expunged. Probably it can. They may even be willing and able to supply you with the forms to do it yourself, and you won't even have to hire an attorney to do it for you. Best of luck!

Re: record expungement

If the charges were dismissed, you have a right to expungement.

Re: record expungement

Contact an attorney. There should be no problem expunging a dismissed charge.
