Legal Question in Criminal Law in Louisiana
What are the rules regarding the holding areas they take you to for accused shoplifting? I was falsely accused of shoplifting, and while in the holding area, I was kept there for hours, they said that I refused to provide a written statement, (which was never an option), when the police officer arrived he made them retype the report because he felt it did not show intent. They say the room was not videotaped, which I wish it was because then it would show that I was telling the truth.

They can hold you until the police arrive. Shoplifting is the taking or attempted taking of something from a store without paying for it. It is a common excuse that someone put something in a pocket or purse then forget to pay for it. Unfortunately, this is still shoplifting.
