Legal Question in Criminal Law in Louisiana

my son was arrested on armed robbery charge,what will happen next and how much time will he get.he has already been in jail 14 mos his case has been reset every month what do this mean.is it good or bad that he has been there that long with out trial.he was on drugs when this happened.its documented that before this happened he was in drug treament program.please help me to understand.

Sometimes trials take a while before they are set. This is a crime of violence because of the weapon. If it was a firearm, there is additional time added. He is looking at not less than 15 yrs. If it was not a firearm, he is looking at ten years. This is a very serious charge and unless the DA agrees to reduce the charges, he will be in jail for some time.

No one can tell you what your son will get. If he is convicted/pleads guilty to armed robbery, he will get 10 years to 99 years at hard labor without benefit of probation, parole or suspension of sentence. Obviously drug rehabilitation did not help him. And I have to tell you that if he was in drug rehab at the time he committed the armed robbery and the rehab was a result of another criminal charge where he got a break, expect the Judge to be hard on him in this case.
