Legal Question in Criminal Law in Louisiana
Student Visa
My boyfriend has a student visa and has been here for 4 years. Last week he was taken in for lewd conduct in the French Quarter NOLA and kept in jail because he also had a previous DWI which happened just before Katrina. Will he be deported? If he goes back to his country will he be able to get back and/or obtain a visa? Will he have a criminal record that will not permitt to come back?

Re: Student Visa
If convicted of an "aggrevated felony" (Immigration's term) he will be deported. Anyone deported from the US cannot legally re-enter without written permission from the Secretary of Homeland Security.
