Legal Question in Criminal Law in Louisiana
traffic stop and going to jail
I was pulled over for speeding. The officer asked me for my insurance, registration, and drivers license. I told him I had to find them. I was talking to him and getting my papers at the same time. After he seen me looking through my papers he asked me to step outside the vehicle. I told him I would get out when I find my papers and he didn't say nothing else. When I looked up about a minute later I was surrounded by police. To make a long story short, all the officers had an attitude telling me to get my papers and get out my vehicle. They had officers on both sides of my truck. The officers raised there voices at me and I raised my voice back at them. The chief ordered the officer to take me to jail and get me out of my truck. In the process the officer was pushing on me trying to unlock my door. When he unlocked my door he pulled me out of my truck. When he pulled me out, I had no balance and the other police officers were reaching at me also. When I got my balance I came up swinging because 3 officers were on me physically man handling me. They took me to jail and charged me with battery on an officer and resisting arrest. I'm a woman driving a 2001 Lincoln Navigator with 22'' rims. Do I have a case against them?

Not unless you have plenty of non-police witnesses.
