Legal Question in Criminal Law in Louisiana
I was wondering if u could help me.
Hello. I am 14 years old. In November 2005, my parents got into a fight while I wasn't at home to break it up. My father choked my mom until she passed out. He did CPR on her until she came back. Then he called for an ambulance. Then in 2006, they separated. My mom has been going through some things with the police here lately and she's ''about to take action.'' She said she is going to press charges on my father, for what happened in 2005. My question to you is can she still press the charges, even though it's been almost 3 years? Please help me with this because I live with my father and I really need to know if he is going to get an attempted murder charge if my mom presses the charges. Please Help me out with this.

First, I'm sorry your parents have difficulty dealing with each other. If there is someone you can talk to (a teacher, guidance counselor, clergyman or even the trustworthy parents of a friend) I suggest you have that conversation.
What someone can be charged with is the decision of the District Attorney for the jurisdiction where the incident occurred. The more serious the offense the longer the DA has to charge a person. Because years have passed and your parents were the only people there; there is a possibility that charges will not be accepted.
